1. Introduction
Welcome to JerseyEngine ("we," "our," "us"). These Terms of Service ("Terms") govern your access to and use of JerseyEngine's website, services, and tools (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.
JerseyEngine provides an online platform for designing custom jerseys, including selecting from our custom jersey templates, adjusting logos, textures and texts, and exporting designs as 2D SVG files. These Terms apply to all users, including visitors, registered users, and businesses.
2. Acceptance of Terms
By using JerseyEngine, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Service. We reserve the right to modify these Terms at any time without prior notice. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
⚠️ Important: You must be at least 13 years old to use JerseyEngine. If you are under 18, you must have parental consent to use our Service.
3. Services Provided
JerseyEngine offers the following features:
- Access to our custom template types and styles
- Customization tools for adjusting logos, templates and texts
- Real-time preview of jersey designs
- Export functionality for 2D SVG files
- Free use of the core design tools
- Premium features (if applicable) for advanced customization
We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice. We are not liable for any changes, suspensions, or discontinuations of the Service.
4. User Responsibilities
As a user of JerseyEngine, you agree to:

- 🔹 Not misuse the Service by interfering with its normal operation
- 🔹 Not attempt to reverse engineer, decompile, or extract source code from our Service

- 🔹 Not upload malicious code, viruses, or harmful content
- 🔹 Respect intellectual property rights of JerseyEngine and third parties
💡 Pro Tip: All designs created with JerseyEngine are your intellectual property. However, the underlying code, templates, and tools remain our property.
5. Intellectual Property Rights
5.1 Our Intellectual Property
JerseyEngine, including but not limited to its code, interface, graphics, logos, templates, and software, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our explicit written consent.
5.2 Your Content & Designs
You retain full ownership of any jersey designs you create using JerseyEngine. We do not claim any ownership rights over your designs. However, by using our Service, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your designs for the purpose of providing and improving our Service.
5.3 SVG Exports
When you export your designs as 2D SVG, you are free to use them for personal or commercial purposes. However, you may not resell or redistribute the SVG templates as your own templates if they are substantially similar to our default templates.
6. Payment & Refunds
Currently, JerseyEngine offers free access to core design features. If we introduce premium features or subscription plans in the future:
- All prices will be clearly displayed before purchase
- Payments are processed securely through third-party payment processors
- Refunds will be handled according to our Refund Policy
- Subscription fees may be subject to change with 30 days' notice
- Unused subscription periods are non-refundable unless required by law

7. Limitation of Liability
To the fullest extent permitted by law, JerseyEngine and its affiliates, officers, employees, and agents shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, or business opportunities
- Damages arising from use or inability to use the Service
- Errors or inaccuracies in generated SVG files
- Third-party content or actions
Our total liability shall not exceed the amount paid by you to use the Service, or $100 if no payment was made.
8. Disclaimer of Warranties
JerseyEngine provides the Service on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, including but not limited to:
- Merchantability or fitness for a particular purpose
- Accuracy or reliability of generated designs
- Uninterrupted or error-free service
- Compatibility with manufacturing processes
- Security of user data
We do not guarantee that the SVG files generated will be suitable for specific manufacturing requirements. Always test your designs before production.
9. User Content & Conduct
You are solely responsible for any content you create, save, or export using JerseyEngine. We reserve the right to remove or disable access to any content that violates these Terms. Prohibited content includes:
- Content that infringes on intellectual property rights
- Illegal, harmful, or fraudulent content
- Content promoting violence, hate speech, or discrimination
- Content that violates any applicable laws or regulations
We may cooperate with law enforcement authorities in investigating violations of these Terms.
10. Termination
We reserve the right to suspend or terminate your access to JerseyEngine at our sole discretion, without notice, for any reason, including:
- Violation of these Terms
- Abuse of our Service
- Extended periods of inactivity
- Legal or regulatory requirements
Upon termination, your right to use the Service will immediately cease. Sections that by their nature should survive termination shall survive.
11. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law principles.
For users in the European Union: Nothing in these Terms deprives you of the mandatory protections afforded to you under the laws of your country of residence (e.g., the EU Consumer Rights Directive). Any disputes arising under these Terms shall be resolved exclusively in the courts located in Delaware, USA, unless you reside in the EU, in which case you may also bring claims in your local courts.

12. Privacy & GDPR Compliance (US & EU)
12.1 Data Collection via Authentication
Because JerseyEngine now collects user data through authentication ("Auth"), we act as a Data Controller for your personal information. When you register, we collect:
- Your email address
- Your name (if provided via OAuth)
- Authentication tokens (e.g., from Google, Apple, or email/password login)
- Design metadata (design names, timestamps, preview thumbnails)
12.2 Legal Bases for Processing (GDPR Article 6)
We process your data based on:
- Performance of a contract (to provide jersey design tools and save your work)
- Legitimate interests (to improve the Service and prevent fraud)
- Consent (for optional marketing emails or analytics)
12.3 Your GDPR Rights
If you are in the EU, you have the right to:
- Access – Request a copy of your data
- Rectification – Correct inaccurate data

- Data Portability – Export your designs and account data
- Object – Opt out of non-essential processing

12.4 Data Retention
We retain your account data for as long as you have an active account, plus up to 12 months after deletion for backup and fraud prevention purposes, unless you request earlier erasure.
12.5 Third-Party Services
We use authentication providers (e.g., Google, Apple, Auth0, Firebase Auth). These providers have their own privacy policies. We recommend you review them.
12.6 Cookies & Tracking
We use essential cookies for authentication and optional analytics cookies. You can manage cookie preferences via our cookie banner.
12.7 International Data Transfers
If you access JerseyEngine from the EU, your data may be transferred to and processed in the United States. We ensure adequate safeguards via Standard Contractual Clauses (SCCs) as approved by the European Commission.
12.8 California Privacy Rights (CCPA/CPRA)
If you are a California resident, you have the right to:
- Know what personal data we collect
- Request deletion of your data
- Opt out of the "sale" of your data (we do not sell your data)
- Non-discrimination for exercising your rights
